In case you are beaten in your home, you may call the police, dialing 110.

The police is entitled to expel the culprit from your home for 10 days. The husband must hand out the keys and leave the home. During this period of time he is not allowed to return to the joint home. The observance of the ban will be checked by the police. The police will draw up a short report which will be given to you. This short report is evidence of the act of violence.

In case your residence permit is still dependant on that of your husband, you may request your own residence permit presenting this document. This will be approved when you stayed with your husband for more than 2 years in Germany or if you are or will be the mother of a German Child. In case the period of 2 years is not complied with, the Ausländerbehörde will review each individual case, don’t be afraid to visit the Ausländerbehörde.

Like German wives you are entitled to Social Assistance without risking extradition.

You may file an express application with the Court Authorities to remain alone in the home. As soon as the application is filed with the Court the culprit will be expelled from the home for an additional 10 days. The Court must reach a verdict within this period of time. After the request has been complied with you and your children may stay in the home. The husband will be permanently banned from the home. In case of the home being the husband´s property, the period of sole right of use will be limited to 6 months.
